On September 22, 2017, the U.S. Department of Education’s Office for Civil Rights issued a new Dear Colleague Letter regarding Title IX enforcement and withdrew previous guidance from 2011 and 2014.  The announcement created some initial confusion, but now, several months later, we have had time to reflect and, more importantly, observe.  Join Bricker attorneys Josh Nolan and Melissa Carleton for their take on where we stand now in terms of the OCR complaint process and what trends may be emerging in terms of administrative dismissals, resolution agreements, and taking new complaints.  We’ll also look into some recent case decisions and what they teach us when determining how to proceed under the new guidance.
