On September 22, 2017, the U.S. Department of Education withdrew the Dear Colleague Letter on Sexual Violence (April 4, 2011) and Questions and Answers on Title IX and Sexual Violence (April 29, 2014). Concurrently, the Department issued a new Dear Colleague Letter and a Q&A on Campus Sexual Misconduct (available here) to “provide information about how [the Office of Civil Rights] will assess a school’s compliance with Title IX while it engages in rulemaking on this topic.” The new Q&A provides guidance on how colleges and universities should address sexual misconduct on campus and contains specific requirements for adjudication, training and management of sexual misconduct cases.
