Bricker Graydon Wyatt Secures Unanimous Victory Before the Kentucky Supreme Court

Bricker Graydon Wyatt is proud to announce a significant victory before the Kentucky Supreme Court, which issued a unanimous decision in favor of the Council for Better Education in its challenge to the constitutionality of House Bill 9.

In its opinion issued February 19, 2026, the Court affirmed Judge Shepherd’s ruling that HB 9 violates Sections 183, 184, and 186 of the Kentucky Constitution, which require that public funds be used to support only public common schools. The decision represents a decisive affirmation of long-standing constitutional protections governing public education funding in the Commonwealth.

The Bricker Graydon Wyatt team representing the Council for Better Education included Byron Leet, Mitzi Wyrick, and Sean Williamson, who handled extensive research, briefing, and oral argument throughout the litigation, including proceedings before the high court last September.

In addition to the Council for Better Education, the firm represented the Dayton Independent Board of Education and the Jefferson County Board of Education in the matter.
